In Arnold et al. v. Sallie Mae, Inc., TMDW attorneys Beth Terrell and Michael Daudt negotiated a $19.63 million settlement for a nationwide class in a case alleging violations of the Telephone Consumer Protection Act. Plaintiffs and Class Members alleged that Sallie Mae made unlawful phone calls to their cellular telephones through the use of automatic telephone dialing systems and/or through the use of an artificial or prerecorded voice without their prior express consent. The Federal District Court for the Western District of Washington granted preliminary approval of the class action settlement in this case, and final approval is currently pending.
In Carideo v. Dell, TMDW attorney Beth Terrell negotiated a nationwide settlement on behalf of consumers who purchased Dell notebook computers. Plaintiffs and class members alleged that Dell acted deceptively in designing, manufacturing, marketing, selling, and servicing the Dell Inspiron 1150, 5100, and 5160. They also alleged that at the time Dell sold these computers, it knew they contained three common defects that could cause premature failure: (1) inadequate cooling systems (2) a power supply system that prematurely fails when used as intended and (3) motherboards that prematurely fail when used as intended. The settlement provides for cash reimbursement for certain repairs to Inspiron Notebook models 1150, 5100, and 5160. The Federal District Court for the Western District of Washington granted preliminary approval of the class action settlement in this case, and final approval is currently pending.
In Odom v. Microsoft Corporation; Best Buy Co.; et al., TMDW attorney Beth Terrell negotiated a settlement providing for refunds of MSN internet subscription charges alleged to be unlawful. Plaintiffs and class members had alleged, among other things, that Microsoft and Best Buy engaged in unfair business practices in connection with the promotion of MSN Internet access service subscriptions at Best Buy stores by offering MSN internet subscriptions with free-trial periods to Best Buy store customers from December 1999 to June 2004 and then charging the subscriber’s credit or debit card at the end of the trial period, even if the subscriber had never logged on to or used the MSN service.
In Barnett et al. v. Wal-Mart Stores, Inc., TMDW attorneys Beth Terrell, Toby Marshall and Jen Murray negotiated a $35 million settlement for a class of 80,000 current and former Wal-Mart employees in Washington State alleging violations of Washington's wage and hour laws and the Washington State Consumer Protection Act.
In Ramirez v. Precision Drywall, Inc., TMDW attorneys Toby Marshall, Erika Nusser and Marc Cote obtained a jury verdict on behalf of 325 drywall workers whose employer deprived them of overtime pay and made unlawful deductions from their pay. Class members were awarded double their actual damages plus interest. Precision Drywall and its owners and officers were also ordered to pay attorneys' fees (with a multiplier) and costs separately. The total judgment is currently valued at more than $4.2 million.
In Perkins v. American Medical Response Ambulance Service, Inc., Beth Terrell obtained a $400,000 jury verdict for a bus passenger who was seriously injured when an AMR ambulance cut off her bus, causing it to swerve off Interstate 5 and into a ditch.
In McGinnity v. AutoNation, Inc., Toby Marshall obtained a $2.34 million arbitration award in a class action brought on behalf of more than 500 employees who were deprived of their earned paid vacation benefits while working at various AutoNation dealerships in Washington.
In Smith v. Norcon Construction, Michael Daudt won a $1.5 million arbitration award for his client in a dispute amongst co-developers of a 100+ unit condominium project in Belltown, including a six-figure attorneys’ fee award as the prevailing party.
In Deer Brush LLC v. Kimball, on behalf of a real estate developer, Michael Daudt and Jennifer Murray defeated a LUPA challenge to their client’s application for a right of way and private easement needed to access its development. Their victory in the trial court was affirmed on appeal.
Beth Terrell and Jennifer Murray negotiated a $2 million settlement on behalf of a nationwide class of employees who had been allegedly misclassified as exempt from wage and hour laws by a major wireless telecommunications carrier.
In Sound Transit v. Smith, Michael Daudt successfully negotiated a $4 million settlement in an eminent domain matter involving commercial property on Seattle’s Capitol Hill on behalf of the property owner.
In a confidential settlement in a lawsuit against a janitorial company, Toby Marshall negotiated a six-figure settlement on behalf of 175 janitorial employees in Washington. Employees alleged violations of state laws regarding minimum wage, overtime, rest and meal breaks, and deductions for uniforms.
In Lindsey & Hayes v. CF Sales, Inc., Beth Terrell and Marc Cote negotiated a settlement of $155,000 for two carpet cleaners who were misclassified as exempt from Washington overtime and rest and meal break laws.
In a lawsuit against a Labor Services Company, TMDW attorneys Toby Marshall and Jennifer Murray negotiated a seven-figure settlement on behalf of 1,300 employees working for labor services company in Washington. The employees had alleged they were not paid for all hours worked, did not receive proper rest and meal breaks, and had unlawful deductions taken from their wages.
In a lawsuit against a Telecommunications Company, TMDW attorneys Beth Terrell and Jennifer Murray negotiated a settlement on behalf of a certified class of 300 employees who alleged wage and hour violations.
In another lawsuit against a Telecommunications Company, TMDW attorneys Beth Terrell, Toby Marshall and Jennifer Murray negotiated a settlement on behalf of 2,400 hourly paid employees in Washington and Oregon. The employees alleged that their employer failed to provide them with meal and rest breaks, did not pay them for all hours worked, and improperly deducted uniform and tool expenses.
In a discrimination case against a Fortune 500 Company, TMDW attorneys Beth Terrell and Toby Marshall negotiated a favorable settlement for an African-American manager who had been terminated after 26 years of employment based on false allegations of sexual harassment.
